    YES!
    This falls under Article III Section 1 New Construction. 
    Make sure your fence does not impede the subdivision water drains and easements.
    Make sure your fence meets all items in this Article.
    Then contact the new construction committee under the "contact us" tab and submit to them your plans.

HOA Building
  • chevron_rightCan we rent the HOA office.
    Yes! The HOA office is available for use for all current homeowners. The building is one large room with 2 bathrooms. 
    • There is a $100 refundable deposit required at the time of renting and will be returned at the end assuming no issues are found with the building.
    • Max capacity is 40 people
    • An adult member of the household is required to be present at all times
    • Renter is responsible for enforcing all state, city, and county guidelines in place at the time of rental.
    • Renter assumes ALL liability if alcohol is served, NO alcohol sales are permitted.
    • HOA and it's Board Members will not be held liable for any injuries, accidents, or deaths steeming from the renter's use of the HOA property

  • chevron_rightCan I decorate for the holidays?
    YES! Article 4, Section 2o of the Declaration of Covenants, Conditions, and the Restrictions States:
    Except for seasonal Christmas decorative lights, which may be displayed between December 1 and January 10 only, all exterior lights must be approved in accordance with Article XI of this Declaration.
  • chevron_rightCan I have a garden?
    YES! Article 4, Section 2m of the Declaration of Covenants, Conditions, and the Restrictions States:
    No vegetable gardens shall be planted or extend nearer the street than the rear yard of any residence and in no event shall be nearer than twenty (20') feet from the street right-of-way line
  • chevron_rightCan I have a pool?
    YES!
    But you will need to contact the "new construction committee" under the "contact us" tab for approval. 
    Pools are required to be fenced in.
  • chevron_rightCan I have pets?
    YES! Article 4, Section 2j of the Declaration of Covenants, Conditions, and the Restrictions States:
    No animals, livestock, or poultry of any kind shall be raised, bred, or kept on any lot, with the exception of dogs, cats, and other domestic pets traditionally recognized as household pets, provided that these pets are not kept, bred, or maintained for any commercial purpose, and provided that such pets be kept within an enclosed area and not permitted off the lot premises except on a leash or under direct control.
     
    Board Notes: Your cat, dog, goldfish, parrot are all acceptable so long as you aren't breeding them.
  • chevron_rightCan I park in the street?
    NO! Article 4, Section 2h of the Declaration of Covenants, Conditions, and the Restrictions States:
    No operable automobile shall be parked on any street in the subdivision for a period in excess of twenty-four (24) hours in any one calendar year.
     
    Board Notes: this does not mean you cannot put your car in the street while you rotate cars around. It is also acceptable that your guest from out of town may need to park there for a couple of days for a short visit. This rule is due to Scott County services such as Fire, EMS, School Bus, and Highway Department not able to navigate streets when cars are parked on street. This even goes for those living in cul-de-sacs. 
  • chevron_rightCan I park my trailer, truck, commercial vehicle, camper trailer, etc on my property?
    NO! Article 4, Section 2g of the Declaration of Covenants, Conditions, and the Restrictions States:
    No trailer, truck, commercial vehicle, camper trailer, camping vehicle or boat, nor any inoperable automobile shall be kept on any lot at any time except inside the attached garage.
     
    Board Notes: we understand that you may have a company automobile of a normal size such as a car or mini-fan and these may have company logos on them. We understand this and these are acceptable. We are more concerned with larger trucks. 
  • chevron_rightCan I put a political sign in my yard?
    NO! Article 4, Section 2L of the Declaration of Covenants, Conditions, and the Restrictions States:
    No signs of any kind shall be displayed on any lot except for signs offering the property for sale or rent of a size no greater than nine (9) square feet, or other necessary and acceptable signs approved in writing by the developer.
  • chevron_rightCan I put up a 25 foot flag pole in my yard?
    NO! Article 4, Section 2p of the Declaration of Covenants, Conditions, and the Restrictions States:.
    No artificial vegetation shall be permitted on the exterior of any portion of the property. Exterior sculpture, fountains, flagpoles, flags, and similar items are prohibited except with the written approval of the NCC.
  • chevron_rightCan I run my business out of my home?
    NO! Article 4, Section 2d of the Declaration of Covenants, Conditions, and the Restrictions States:
    No trade or business of any kind, including professional occupations, shall be conducted on any lot, except that the builder of a new house may use it as the builder's own office or model home for display for a period not to exceed two years from completion of the construction and only with the written consent of the Board.
  • chevron_rightCan I subdivide my property?
    NO. Article 4, Section 2a of the Declaration of Covenants, Conditions, and the Restrictions States:
    No additional subdivision of any lot shall be made without the written consent of the Board of the Association and any appropriate governmental body, nor shall any zone changes be requested for this property without the prior written approval of the Board.
  • chevron_rightCan I turn my home into apartments?
    NO! Article 4, Section 2c of the Declaration of Covenants, Conditions, and the Restrictions States:
    No lot in the subdivision shall be used for any purpose except private single-family residential purposes without the written permission of the Board.
  • chevron_rightCan I use a temporary building on my lot?
    NO. Article 4, Section 2e of the Declaration of Covenants, Conditions, and the Restrictions States:
    No temporary structures shall be permitted on any lot except temporary tool sheds and/or field offices used by builders and/or developers, and these shall not be permitted to remain after the particular construction or development has been completed.
     
    Board notes, during times of reconstruction or acts beyond your control such as water pipe bust, we understand that temporary storage or dumpster may need to be used and is approved, we do ask that you inform the board of the issue and the estimated length of time.
  • chevron_rightI want to rent my house out, can I do that?
    YES! Article 4, Section 2b of the Declaration of Covenants, Conditions, and the Restrictions States:
    Leasing, defined as the regular, exclusive occupancy of a Lot by any person or persons other than the Owner for which the Owner receives any consideration or benefit, of any lot is permitted only if the lot is leased in its entirety; no fraction or portion may be leased. There shall be no subleasing of Lots or assignment of leases unless prior written approval is obtained from the Board of Directors. No transient tenants may be accommodated on any Lot. All leases shall be in writing and shall be for an initial term of no less than six (6) months, except with the prior information as may be required by the Board, shall be given to the Board by the Lot Owner within ten (10) days of the execution of the lease. The Owner must make available to the lessee copies of the Declaration, By-Laws, and the rules and regulations, and the owner will be ultimately responsible for any violations and losses to the Common Areas by the lessees.
  • chevron_rightMy neighbor has a messy property, can we make them clean it up?
    YES! Article 4, Section 2I of the Declaration of Covenants, Conditions, and the Restrictions States:
    No portion of the property or any lot shall be used, in whole or in part, for the storage or any property or thing that will cause it to be in an unclean or untidy condition or that will be obnoxious to the eye; nor shall any substance, thing, or material be kept thereon that will emit foul or obnoxious odors or that will cause any noise or other condition that will or might disturb the peace, quiet, safety, comfort, or serenity of the occupant of surrounding property. No noxious or offensive activity shall be carried on upon any portion of the property or any lot, not shall anything be done thereon tending to cause embarrassment, discomfort, annoyance or nuisance to any person using any portion of the property. There shall not be maintained any plants or animals or device or thing of any sort whose activities or existence in any way is noxious, dangerous, unsightly, unpleasant, or of a nature as may diminish or destroy the enjoyment of property
     
    YES! Article 4, Section 2k of the Declaration of Covenants, Conditions, and the Restrictions States:
    No trash, garbage, or rubbish shall accumulate upon any lot except in suitable sanitary containers approved in writing by the NCC. It shall be the responsibility of each Owner to prevent the development of any unclean, unhealthy, unsightly, or unkempt condition on his or her Lot

    NO! Article 4, Section 2n of the Declaration of Covenants, Conditions, and the Restrictions States:
    The discharge of firearms within the property is prohibited. The term “firearms” includes “B-B” guns, pellet guns, and other firearms of all types, regardless of size
